Fair Pricing and Transparency Ordinance
Summary
Seattle’s proposed Fair Pricing and Transparency Ordinance would add Chapter 7.35 to the Seattle Municipal Code, effective September 1, 2027. It would prohibit covered grocery retailers, mixed-use stores, and qualifying delivery services from using personal information—such as browsing activity, demographics, location, purchase history, or third-party data—to set individualized prices or fees. It would also bar electronic shelf labels from displaying algorithmically varied prices. The measure applies mainly to large grocery businesses, mixed-use retailers, and delivery providers, while preserving store-based pricing, delivery-cost differences, public group discounts, manufacturer coupons, and limited tiered loyalty discounts. Covered businesses must disclose discount criteria, retain compliance records for three years, and face City Attorney enforcement. Injured consumers may sue certain larger retailers. The ordinance seeks more predictable, transparent, and equitable pricing for groceries and other essential goods.
