A resolution authorizing Nashville Phase III Property Holder LLC to construct, install, and maintain an aerial encroachment at 507 Houston Street. (Proposal No. 2026M-029EN-001).

Summary

This license agreement allows Nashville Phase III Property Holder LLC to construct, install, maintain, or operate a private encroachment in Nashville’s public right of way, as authorized by a Metropolitan Council resolution. The property holder must protect and indemnify Metro Nashville against claims arising from the encroachment and maintain an approved bond or liability insurance. The coverage must provide 30 days’ cancellation notice; failure to maintain it may create a Metro lien. The agreement cannot be transferred without approval from NDOT and the Metropolitan Attorney. Metro may revoke the license by Council resolution when necessary for public welfare, without compensation. The encroachment must not interfere with Metro’s rights or responsibilities.
